Using Niji Diary

Niji Diary is provided by Jignesh Patel (referred to below as “we” or “us”). By using the service, you agree to these terms and the applicable terms of the store through which you obtain the app. For the app obtained through Apple’s App Store, these terms are our custom end-user license agreement.

Account holders must be adults and may manage family records for people in their care. Use the service only with permission to process and share the information you add. You retain ownership of your records. You give Niji and its service providers the limited permission needed to process content you choose to send for assistance, sharing or support.

Apple app license

Agreement and permitted use

This agreement is between you and us. Apple is not a party; we alone are responsible for the app and its content. We acknowledge the opportunity to review the Apple Media Services Terms and Conditions effective on this agreement’s effective date. Their applicable usage rules prevail over any inconsistent restriction here.

Your app license cannot be transferred and permits use on Apple-branded devices you own or control, within Apple’s usage rules. Other accounts connected to the purchaser may use the app through Family Sharing, volume purchasing or Legacy Contacts where Apple permits. Applicable Volume Content Terms also apply.

Maintenance and support

We alone provide app maintenance and support described here or required by law. You and we acknowledge that Apple has no duty to provide either. Contact us using the developer details below.

Warranties

We alone are responsible for express warranties and legally imposed warranties that have not been validly excluded. If the app fails to meet an applicable warranty, notify Apple, which will refund the app’s purchase price. To the fullest extent the law permits, Apple has no further warranty duties; all other warranty-related claims, losses, liabilities, damages, costs and expenses are solely our responsibility.

Product and intellectual property claims

You and we acknowledge that we alone handle your or another party’s claims concerning the app or your possession or use of it. These include product liability, legal or regulatory noncompliance, and consumer-protection, privacy or similar claims, including claims concerning any use of HealthKit or HomeKit. Our liability cannot be limited beyond what applicable law permits.

If a third party alleges that the app or your possession or use of it infringes intellectual property rights, we alone are responsible for investigating, defending, settling and satisfying that claim. Apple bears none of those responsibilities.

Legal compliance and other agreements

You represent and warrant that you are not in a country under a U.S. government embargo or designated by that government as supporting terrorism, and that you are on no U.S. government list of prohibited or restricted parties. When using the app, comply with relevant third-party agreements, including your mobile carrier’s data-service agreement.

Apple’s enforcement rights

You and we agree that Apple and its subsidiaries are third-party beneficiaries of this agreement. Your acceptance gives Apple the right to enforce this agreement against you as a beneficiary; Apple is treated as having accepted that right.

Your local diary and recovery

Your local diary is stored in an encrypted device vault. Keep a verified encrypted backup and protect the recovery material. Removing an app, clearing browser data or losing keys can prevent recovery. We cannot restore a device-only vault without the recovery material you control. An online account or subscription is not a backup of your diary.

Optional AI

Online assistance sends the content needed for your request to the service providers described in our privacy policy. It requires connectivity and may have usage limits. AI Off makes no AI requests. AI output can be incomplete or incorrect; check extracted details, reminders and suggested actions before relying on them.

Niji Diary is an organization aid, not an emergency, medical, legal, financial or safety-critical service. It does not diagnose, prescribe, calculate medication doses or replace professional advice. Do not rely on a reminder as your only safeguard for a critical task.

Subscriptions and time packs

The purchase screen shows the available plan, included features and allowance, billing period, local price and applicable offer before you confirm. The store price at checkout is authoritative. Monthly and annual subscriptions renew automatically unless cancelled through your store account before renewal according to the store’s rules. Removing the app or deleting the Niji account does not cancel a subscription.

Individual, Family and Work are separate service plans. Included monthly Diary time resets for each allowance period and is not unlimited. An annual payment does not make the entire year’s monthly allowance available immediately. The 30-minute Diary Time pack adds non-expiring extra live time; it does not unlock Family or Work features. Plan features, shared limits and current availability are shown before purchase.

Use Restore purchases or the purchase-status controls in Plans and membership if access has not updated. Refunds and cancellations are handled through the store that billed you, subject to its rules and your statutory rights. Changes to subscription prices or terms will follow applicable store and legal notice requirements.

Responsible use and availability

Do not access another person’s data without authorization, bypass payment or security controls, disrupt the service, submit unlawful content, or use Niji Diary to harm others. We may restrict online access where necessary to protect users, comply with law or address abuse. Local records remain under your control.

Online features may change or be temporarily unavailable. Device compatibility, connectivity and operating-system permissions affect operation. We take reasonable care in providing the service but do not promise uninterrupted availability or error-free AI. Nothing in these terms excludes rights or remedies that applicable consumer law does not allow us to exclude.

Ending use and changes

You can stop using the service at any time, cancel recurring purchases in your store and delete service-held account records using the deletion process. Export first if you need a copy of local records. We will update the effective date when these terms change and communicate material changes through an appropriate app or account channel.
